Are hedge funds the new, er, private equity? It is a question that a growing number of transactional lawyers are asking themselves as buy-out clients become increasingly paranoid that hedge funds are invading their territory.

Such predictions come after two years in which it has looked increasingly certain that a good chunk of the capital mountain accumulated in the alternative investment sector – currently estimated to be in excess of £600bn – would find its way into direct M&A.
