WASHINGTON – CUNA has filed a motion for summary judgment to dismiss the Gold Banc Corporation lawsuit over the credit union brand "Where people are worth more than money." The Kansas City bank filed a complaint in the U.S. District Court for the District of Kansas claiming the National CU Brand Campaign slogan infringes on its service mark, "More than money" and is causing confusion in the marketplace. The bank, which operates in Kansas, Missouri, Oklahoma and Florida, is seeking a settlement in which CUNA and credit unions would stop using the slogan in their promotion and advertising and destroy any existing branded materials. According to the CUNA motion filed recently, since there is no dispute as to any material facts, no infringement of the bank's trademark and the bank has not provided any evidence to show consumers find the marks confusingly similar there is no reason to go to trial. "The time has come to put an end to this costly and wasteful process," said CUNA General Counsel Eric Richard. "After months of discovery, including requesting over 33,000 pages of documents from CUNA, Gold Banc has found nothing that proves their case." The credit union trademark was registered in July 1999, while Gold Banc's application for its motto was still pending. Since filing suit, Gold Banc, a bank holding company with about $3 billion in assets, sent subpoenas to 103 credit unions, four credit union leagues, and CUNA, requesting information and documents relating to their use of the brand. Credit unions have been advised to continue to use the national CU brand.
