U.S. District Judge Manuel Real was reversed and rebuked by the 9th U.S. Circuit Court of Appeals on Tuesday.

An appeals court panel reversed Real for throwing out a plaintiff’s case when an attorney failed to appear for a hearing that was noticed by e-mail only. In the unsigned per curiam opinion, the three 9th Circuit judges also said Real acted with “unseemly haste” by dismissing the case in spite of a “perfectly plausible (and meritorious) explanation” from plaintiffs attorney Stanley Raskin.
