This simple fact pattern raised a complex legal question for a New York appeals court in interpreting the state's 1995 death penalty statute, which provides that a suspect accused of committing two or more murders in the "same criminal transaction" may be subject to the death penalty.

“Ant Live” and “Mr. T,” two Poughkeepsie, N.Y., drug dealers, confronted the Mann brothers, two out-of-towner dealers who were poaching on their turf, and gunned them down on Nov. 18, 1995.
“Ant Live,” the street name used by Anthony L. Reed, killed one Mann brother, and “Mr. T,” whose real name is Raymond Earl Warren, killed the other.
