ESTATE OF ROBERT A. KOEPPEL, Deceased. (96/4098/A) — In a proceeding commenced by order to show cause, former counsel to William Koeppel seeks to hold him in contempt for violating certain orders of this court. The matter was first adjourned to a special court calendar on November 5, 2015, from the court’s regular calendar on October 16, 2015, at the request of counsel for Koeppel, and on the consent of counsel for the petitioning law firms. The parties appeared on November 5, 2015, and counsel for Koeppel requested a settlement conference as well as an adjournment of the hearing on the issues raised by the contempt petition based on a family medical emergency of counsel. The court held the settlement conference, which failed to yield a settlement, and granted the requested adjournment of the contempt hearing to December 1, 2015 at 2:30 p.m. Counsel and Koeppel were directed to appear on that date and time. The parties were further directed to be prepared to present any evidence relevant to the question of Koeppel’s criminal or civil contempt at that time. Any trial subpoena sought to be so ordered by the court shall be submitted to the court by a party no later than November 19, 2015, with copies served on opposing counsel by that date.

Koeppel opposed the contempt petition by cross-motion which sought a deposition of Craig Avedisian, who is representing his firm, the Law Offices of Craig Avedisian, and the other petitioning firm, Richenthal, Abrams and Moss. By decision from the bench on December 2, 2014 (written decision entered December 8, 2014), the court permitted an examination of either Avedisian or Koeppel provided it occurred no later than January 2, 2015. Any extension of time to conduct such depositions was explicitly conditioned on good cause shown.
