On 14 July the European Commission (EC) proposed a regulation bringing the amended Brussels Convention covering legal jurisdiction into EU law – the so called ‘Brussels Regulation’. The original convention, signed in 1968, contained rules that state that if a business directly solicits a foreign consumer, the courts of that consumer’s country of residence would take jurisdiction in a contractual dispute.

The convention’s new text states that if a company directs activities towards one or several member states, the court of the consumer’s country of residence can take jurisdiction in the event of a contractual dispute.
