ST. LOUIS – The drawn-out battle over field of membership expansion in Missouri moved another step toward resolution Oct. 3, when a three-judge appeals panel heard oral arguments in the case filed by the Missouri Bankers Association. The issue before the court is whether or not banks have standing to appeal a decision of the newly formed Missouri Credit Union Commission. The banks are opposing decisions by the credit union commission granting community charters to credit unions for multi-county membership fields. The banks argue that the credit union commission should not have granted Springfield Telephone Employees CU, which has since changed its name to TelComm CU, a charter with so broad a FOM. A decision is expected in 90 to 120 days. Either side can then appeal to the Missouri Supreme Court. If the bankers win, the case would return to the circuit court for a review on the merits. Peggy Nalls, senior vice president of public/legislative affairs for the Missouri Credit Union System, attended the hearing and thought the judges understood the credit union side of the issue and were more comfortable with those arguments than with those of the bankers. "They didn't seem to think (the bankers') arguments were the best," she said.
